End User License Agreement

Agreement to License

This End User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and Tintz for the software product identified above, which includes computer software and may include associated media, printed materials, and online or electronic documentation (“Software Product”).

By installing, copying, or otherwise using the Software Product, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software Product.

Software Product License

Grant of License

Subject to the terms and conditions of this EULA, Tintz grants you a limited, non-exclusive, non-transferable, revocable license to use the Software Product solely for your personal or commercial use in accordance with this EULA and any additional terms provided with the Software Product.

License Restrictions

You may not copy, modify, adapt, alter, translate, or create derivative works of the Software Product
You may not reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code of the Software Product
You may not rent, lease, lend, sell, sublicense, or otherwise transfer the Software Product or your rights under this EULA
You may not use the Software Product for any illegal or unauthorized purpose
You may not remove or alter any proprietary notices or labels on the Software Product

Subscription and Payment Terms

Free Tier

The Software Product is available with a free tier that includes basic color extraction features, limited palette storage, and essential export formats. This free tier is provided “as is” without any warranties.

Premium Subscriptions

Premium features are available through monthly or lifetime subscriptions. Subscription fees are charged in advance and are non-refundable except as required by law. You authorize us to charge your payment method for all fees incurred.

Subscription Cancellation

You may cancel your subscription at any time through your device's subscription management settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial billing periods.

Premium Features and Benefits

Unlimited Palette Creation & Storage

Premium users can create and store unlimited color palettes with persistent cloud storage across all devices. This enables users to build comprehensive color libraries for multiple projects.

Complete Tool Suite Access

Unlocks all advanced color analysis tools including gradient mixer, color converter, laser scan animation, premium color extraction algorithms, and batch processing capabilities for multiple images.

Premium Export Functionality

High-resolution palette exports suitable for professional design work, multiple export formats (PNG, PDF, color codes), ability to share palettes with team members or clients, and export without watermarks or quality limitations.

Intellectual Property Rights

The Software Product and all intellectual property rights therein are and shall remain the exclusive property of Tintz and its licensors. This EULA does not grant you any rights to trademarks or service marks of Tintz.

User Content and Data

You retain ownership of any content you create using the Software Product. By using the Software Product, you grant Tintz a limited license to process and store your content solely for the purpose of providing the service. We do not claim ownership of your content.

Privacy and Data Protection

Your privacy is important to us. The collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into this EULA by reference.

Disclaimers and Limitations

THE SOFTWARE PRODUCT IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. TINTZ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TINTZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software Product and destroy all copies.

Governing Law

This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which Tintz operates, without regard to its conflict of law provisions.
